Shuttertec Ltd – Terms and Conditions

These Terms and Conditions govern the supply, manufacture, delivery and installation of goods by Shuttertec Ltd.

By placing an order with Shuttertec Ltd you agree to be bound by these Terms and Conditions.

Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015.

1. Company Information

References to “we”, “us”, or “Seller” refer to Shuttertec Ltd.

References to “you” or “Buyer” refer to the customer placing the order.

2. Orders

2.1 Each order placed with Shuttertec Ltd constitutes a legally binding contract once accepted by us.

2.2 Orders are confirmed once:

• Written confirmation of the order has been received (email, message, or signed document), and

• The required deposit has been paid.

2.3 All products supplied are bespoke and made to measure according to the specifications agreed with the Buyer and therefore, cannot be cancelled once the order has been placed.

2.4 It is the Buyer’s responsibility to ensure all order details are correct when confirming the order.

3. Pricing and Payment

3.1 All prices are inclusive of VAT where applicable unless otherwise stated.

3.2 Payment is typically required in two stages:

• A deposit is payable when placing the order.

• The remaining balance payable prior to or at the time installation is scheduled.

3.3 Installation dates are not confirmed until the outstanding balance has been paid, unless otherwise agreed in writing.

3.4 We reserve the right to request full payment prior to installation if necessary.

3.5 Payments accepted:

• Bank transfer
• Debit card
• Credit card
• Cash

Cash payments over £1000 may incur a 1% handling fee.

3.6 Payment is due upon completion of installation unless agreed otherwise.

3.7 If payment remains outstanding beyond 7 days, we reserve the right to charge interest on overdue balances at 4% above the Bank of England base rate, calculated daily.

3.8 If payment remains unpaid after reasonable attempts to recover the balance, the debt may be referred to a collection agency and reasonable recovery costs may be added.

4. Deposits and Cancellations

4.1 Deposits are required to confirm an order.

4.2 As all goods are custom-made, deposits are generally non-refundable once manufacturing has commenced.

4.3 If cancellation occurs before manufacturing begins, Shuttertec Ltd may retain a reasonable portion of the deposit to cover:

• survey and design work
• administrative costs
• materials ordered

4.4 Where orders are placed in the customer’s home or remotely, cancellation rights may apply under the Consumer Contracts Regulations 2013.

4.5 Where the Buyer requests that manufacturing begins within the statutory cooling-off period, the Buyer acknowledges that cancellation rights may be reduced once production has started.

5. Manufacturing and Product Specifications

5.1 All shutters and related goods are manufactured within accepted industry tolerances.

5.2 Manufacturing tolerances:

• Overall panel and frame dimensions: ±2mm
• Warp tolerance: 1mm per 300mm

5.3 Horizontal middle rail placement may vary by up to half a louvre depending on shutter style and configuration.

5.4 Due to the nature of natural materials and finishing processes:

• Minor variations in colour, grain or finish may occur.

• Exact colour matching to samples cannot be guaranteed.

5.5 Where additional products are ordered at a later date, colour or finish differences may occur due to manufacturing batch variations.

Such differences shall not be considered defects.

6. Delivery and Lead Times

6.1 Lead times provided at the time of ordering are estimates only.

6.2 Lead times begin once:

• order details are confirmed in writing, and
• the deposit has been received.

6.3 We will make reasonable efforts to keep the Buyer informed of any delays.

6.4 Shuttertec Ltd shall not be liable for delays caused by circumstances outside our reasonable control including:

• manufacturing delay
• shipping delays
• supplier issue
• force majeure events

7. Installation

7.1 Installation will be arranged once goods are ready and payment requirements have been satisfied.

7.2 The Buyer must ensure:

• clear access to installation areas
• window openings are fully prepared
• existing window coverings are removed

7.3 The Seller cannot be held responsible for:

• weak plaster or window surrounds
• hidden wiring or plumbing
• structural defects in walls or window openings.

7.4 Where windows, recesses or sills are uneven, it may be necessary to adjust or plane the product to achieve correct installation. This is normal practice and shall not be deemed a defect.

7.5 If installation cannot proceed due to circumstances caused by the Buyer (including access issues or unfinished building work), additional charges may apply.

8. Storage

8.1 Where installation is delayed by the Buyer after goods are ready, the goods may be placed in storage.

8.2 Storage may be charged at £15 per week including VAT after a reasonable storage period. (2 calendars month from the delivery date)

8.3 Installation should normally occur within 6 weeks of goods being ready for installation.

9. Missed Installation Appointments

9.1 If an installation appointment is missed or cancelled with less than 24 hours notice, Shuttertec Ltd reserves the right to charge a £350 missed appointment fee. The balance of the invoice will be required to be paid in full, with the additional costs, before the installation then takes place.

This charge reflects labour costs and reserved installation time.

10. Risk and Ownership of Goods

10.1 Ownership of goods remains with Shuttertec Ltd until full payment has been received.

10.2 Risk in the goods passes to the Buyer once installation is completed.

11. Warranty and Guarantees

11.1 All goods supplied and installed are covered by manufacturer warranties from the date of installation.

Typical warranty periods include:

• Paulownia hardwood – 10 years structural / 5 years colour fastness
• Endurance hardwood – 15 years
• MDF shutters – 10 years
• Basswood shutters – 10 years
• PVC shutters – 10 years
• Perfect Fit shutters – 10 years
• Blinds – 1 year
• Blind screens internal – 5 years
• Blind screens external– 2 years

11.2 Installation workmanship is guaranteed for 12 months from installation.

11.3 The warranty does not cover:

• normal wear and tear
• misuse or accidental damage
• exposure to excessive moisture or condensation
• fading caused by prolonged sunlight exposure.

11.4 Minor imperfections not visible from five feet under normal lighting conditions shall not be considered defects.

11.5 Guarantees apply only once invoices have been paid in full.

12. Service Calls

Service visits outside of warranty may be charged at:

• £80 for the first hour
• £50 per additional hour
•Maximum £250 per day

Standard slat replacement:

• £50 including VAT for the first two slats
• £10 per additional slat

Warranty callouts that are found not to be warranty issues may incur a £100 call-out charge.

13. Limitation of Liability

13.1 Nothing in these Terms shall limit or exclude liability for:

• death or personal injury caused by negligence
• fraud or fraudulent misrepresentation

13.2 Subject to the above, Shuttertec Ltd’s total liability shall not exceed the value of the contract.

14. Privacy and Data

Personal data collected during the ordering process will be handled in accordance with our Privacy Policy and applicable legislation including the UK GDPR.

15. Website Use

The content of our website is for general information only and may be updated from time to time.

Unauthorised use of the website may give rise to a claim for damages and/or be a criminal offence.

Links to third-party websites are provided for convenience and do not signify endorsement.

16. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes arising from these terms shall be subject to the jurisdiction of the courts of the United Kingdom.
